Acceptable Use Policy

1. General Information

As a provider of Internet-related services and products, Hoster solutions ("Company") provides its customers with means to acquire and disseminate a variety of information. The Company respects that the Internet is a forum for free and open discussion and dissemination of information, however, when competing interests arise, the Company reserves the right to take certain preventive or corrective actions. To protect these competing interests, the Company has developed this Acceptable Use Policy ("AUP"), which supplements and explains the offer and is intended as a guide to the rights and obligations of the customer in the use of the Company's services and products. This AUP will be revised from time to time. The customer's use of the Company's services and products after posting changes to the AUP on the company's website will constitute the customer's acceptance of any new or additional terms of the AUP resulting from such changes. One of the important aspects of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use the Internet, both in the information they acquire and in the information they disseminate to others. When users obtain information through the Internet, they should keep in mind that the Company cannot monitor, verify, warrant or vouch for the accuracy and quality of the information that users may acquire. For this reason, the user must exercise his best judgment in relying on information obtained from the Internet, and also should be aware that some materials posted on the Internet may be sexually explicit or otherwise offensive. Since the Company cannot monitor or censor the Internet and will not attempt to do so, the Company cannot accept any responsibility for injury to its users, customers or subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications. When users or customers disseminate information through the Internet, they also must keep in mind that the Company does not review, edit, censor or take responsibility for any information that its users, customers or subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation, and other harmful speech. Also, because the information they create is carried over the Company's network and may reach a large number of people, including both customers and subscribers and non-subscribers of the Company, the messages of customers and subscribers on the Internet may affect other customers and subscribers and may harm the Company's goodwill, business reputation and operations. For these reasons, customers and subscribers violate the company's policy when they, or their customers, affiliates or subsidiaries engage in the activities described in this document.

2. Purpose

This document ("AUP") governs the use of the Company's products and services ("Services"). This AUP is incorporated by reference into each contract the Company enters into with a purchaser (each, a "Customer") for the use of such Services and products. The Company may modify this AUP at any time without notice. In addition, this AUP is incorporated by reference into the Terms of Service applicable to the Company's website, so no person using the Company's website (regardless of whether such person is a Customer) may take any action using the Company's website that is prohibited by this AUP.

3. Prohibited Use

Customers and users may not:

  • Use the Services and products to send unsolicited mass and/or commercial messages over the Internet (known as "spam"). This is harmful not only because of its negative impact on consumer attitudes toward the Company, but also because it can overload the Company's network and disrupt service to subscribers. Use of open SMTP relay is prohibited. Any direct action, configuration or parameter that causes excessive outgoing mail traffic is subject to review and possible subsequent actions aimed at correcting this situation. When a complaint is received, the Company has the absolute and sole discretion to determine based on all available evidence whether the email recipients were from a mailing list that agreed to receive such information, or whether the outgoing mail traffic generated from the account is acceptable for the hosting environment.
  • Use the Services and products in connection with any illegal activity. Without limiting the general application of this rule, Customers and Users are prohibited from:
    • using the Services and products to copy materials of third parties (including text, graphics, music, video or other materials protected by copyright) without proper permission;
    • using the Services and products to improperly appropriate or infringe patents, copyrights, trademarks or other intellectual property rights of any third party;
    • using the Services and products to trade drugs, illegal gambling, obscene materials or other products or services prohibited by applicable law;
    • using the Services and products to export encryption software in violation of applicable export control laws;
    • using the Services to forge or misrepresent message headers, in whole or in part, to mask the sender of the message;
    • using the Services and products in any manner that violates applicable law.
  • Use the Services in connection with harmful activities. Without limiting the general application of this rule, Customers and Users may not: use the Services to publish or distribute information that 1) constitutes defamation, 2) publishes personal information or image of a person without that person's consent or 3) otherwise violates any person's privacy rights. Use the Services and products to threaten people with bodily harm, make offensive statements or messages, or demand actions or services that are illegal under applicable law.
  • Use the Services and products in connection with any other disruptive or offensive activity. Without limiting the general application of this rule, Customers and Users are prohibited from:
    • using the Services and products to cause "denial of service" attacks against the Company or other network nodes or Internet users, or otherwise degrade the performance of the Company's servers and facilities or servers and facilities of other network nodes or Internet users;
    • publishing messages or programs that consume excessive amounts of processor resources, disk space or network bandwidth;
    • using the Services and products for the purpose of offering mail services, mail forwarding capabilities, POP accounts or autoresponders, except for the user's own account;
    • using the Services and products to undermine or assist others in undermining the security or integrity of any of the Company's systems, facilities or equipment;
    • using the Services and products to gain unauthorized access to the Company's computer networks or any other person's computer networks;
    • using the Services and products to provide passwords or access codes to persons not authorized to receive such materials by the administration requesting the password or access code;
    • using the Services to distribute or publish any viruses, worms, trojans or computer code/parts of code designed to destroy data, destroy or damage equipment, or disrupt the Services;
    • using the Services and products to conduct port scanning or other procedures on any server (other than any server for which the User is an authorized system administrator);
    • using the Services and products to distribute, advertise or promote software or services whose primary purpose is to encourage unsolicited commercial email or spam;
    • using the Services and products to request or collect, or distribute advertising or promotion of email address lists for the purpose of encouraging or facilitating the sending of unsolicited commercial email or spam;
    • using the Services and products in any manner that may subject the Company to unfavorable regulatory action, subject the Company to any liability for any reason, or adversely affect the Company's public image, reputation or goodwill, including, without limitation, sending or distributing sexually explicit content, racially, ethnically or otherwise discriminatory materials, as determined by the Company in its sole discretion;
    • while on the service platform, use, operate, include, execute, compile, upload or publicly store source code, executable code, programs or software packages designed to perform tasks not directly related to web hosting/email hosting, including, without limitation, 1) directly opening any listening port, 2) running any "daemon" process, 3) performing local/remote security scanning, 4) simulating local OS shell access through any connection to a remote host, 5) bypassing firewall restrictions, 6) connecting to any IRC/peer-to-peer server/file sharing network, 7) providing "tracker" services to "torrent" clients and/or 8) using web browser vulnerabilities, as determined by the Company in its sole discretion;
    • attempt to attack, disrupt or abuse the Company's support mechanisms, including, without limitation, telephone lines, email addresses, fax lines, bulletin boards or any other forms of contact/subscription;
    • use the Services and products in any other way to interfere with the use of the Internet by others;
    • use the Services and products to host online pharmacies with illegal pharmaceuticals;
    • use the Services and products to host anonymous imageboards with offensive content and/or lack of moderation;
    • VPS only: Organizing public VPN/proxy services without coordination with the Company's administration;
    • setting up and using proxy servers without authorization;
    • TOR exit nodes;
    • VPS only: cryptocurrency mining
    • use the Services and products to host Replica sites/stores selling copies of watches, bags, clothing, etc. without prior coordination with the administration;
    • proxy projects through our Servers/VPS;
    • use our Servers/VPS for Anti-DDoS protection of third-party projects (not hosted on our Servers/VPS) by proxying/tunneling traffic;
    • add and use IP addresses that do not belong to you. In case of detection of such abuses, we immediately block the server and impose a fine from $500 to $1000;
    • any activities that lead to blocking of our IPs and networks by mail services. Fine for repeated blocking from $50 to $250;
    • VPS only: hosting traffic-generating scripts, sites and other resources (audio/video streaming, file storage, etc.);
    • VPS only: creating SWAP file for plans with SSD and NVMe disks;
    • VPS only: exceeding the recommended maximum channel load on a permanent basis;
    • VPS only: any activities (proxying, tunneling, streaming, any others) that create disproportionately high load on network resources or bandwidth.

IMPORTANT: In case of detection of violations of these rules, we reserve the right to suspend or terminate the provision of services and products without prior notice and/or refund.

3.1 SMTP Port Blocking/Unblocking

SMTP ports (25 and others) are blocked by default on Linux Starter and Linux Optimal plans for security purposes. To unblock SMTP ports, you will need to go through the KYC identification procedure and top up your account balance for the amount of payment for the service for at least 3 months. The specified amount will be used as a security deposit and may be used to pay for service renewal.

3.2 Mass Mailings

Using our servers for any mass mailings is strictly prohibited. In case of receiving complaints related to mass mailings, or detecting such activity, your service and products will be immediately blocked without the possibility of refund. If you need to send mass mailings, we recommend using third-party services.

3.3 IP Getting into Blacklist

Fine for getting our IP addresses into blacklists - $15 for each case of getting into the list.

4. Channel Load

Although we provide a port speed of 1Gbit/s and do not count traffic (unmetered), the service is not intended for continuous extremely high traffic usage.

4.1 Recommended average/constant channel load for VPS should not exceed:

For VPS with 1 Gbit/s port:

  • Starter plan: 10 Mbit/s
  • Optimal plan: 15 Mbit/s
  • Standard plan: 20 Mbit/s
  • Basic plan: 50 Mbit/s
  • Professional plan: 80 Mbit/s
  • Professional Improved plan: 100 Mbit/s

For VPS with 1 Gbit/s port in Singapore, Japan, Hong Kong, UAE, Australia, Brazil, Turkey:

  • Starter plan: 5 Mbit/s, traffic limit 1000GB/month, overage cost $0.01 per 1GB
  • Optimal plan: 10 Mbit/s, traffic limit 2000GB/month, overage cost $0.01 per 1GB
  • Standard plan: 15 Mbit/s
  • Professional plan: 20 Mbit/s
  • Professional Improved plan: 50 Mbit/s
  • For each additional 10Mbit/s bandwidth, a fee of $25 per month is charged, for UAE - $35 for 10Mbit/s.

IMPORTANT: In case of detection of symmetrical channel load, both incoming and outgoing traffic will be counted.

We reserve the right to limit the channel to the above values in case of persistent abuses, or if exceedances create problems for other customers.

For PROMO plans, the recommended load is divided by 2. That is, if for the Professional plan the recommended load is 50Mbit/s, then for Professional - PROMO - 50/2=25Mbit/s.

Example 1: Standard plan. Every day from 18 to 22 hours you have maximum peak traffic on your website and the channel load increases from the standard 10Mbit/s to 40Mbit/s. No sanctions from our side will follow for such a temporary increase.

Example 2: Starter plan. Every day, for several days/weeks we see constant channel load of more than 50Mbit/s. Depending on the total load on the head server channel, we may decide to forcibly limit to 10Mbit/s.

4.2 Procedure for notification of limit application:

  • in case the situation is not critical, we create a notification and inform you about exceeding the maximum recommended load for your tariff plan and give 24 hours to resolve the issue: reduce the load or switch to a tariff plan where the permissible load is higher. In case of no response, we set limits and inform you about this by letter.
  • in case your VPS load creates problems for other server customers, we urgently set limits and make a corresponding notification by letter.

5. Violations

5.1 Disclaimer

The Company expressly disclaims any obligation to monitor its customers and other users for violations of the Offer. The Company is not responsible for the actions of its Customers or other Users or any content that a User may post on any website.

5.2 Reporting Copyright Violations

The Company encourages users to report violations of this policy by email, including in any such report the name of the violating domain (e.g., xyz.com) and the type of abuse (e.g., spam, illegal activities, harassment, etc.) in the "Subject" field of the email.

5.3 Remedies

If the Company learns of a violation of this AUP, the Company will respond to the appropriate Customer and may, in its sole discretion, take any of the following actions in accordance with the severity and duration of the violation:

  • warning the Customer; and/or
  • suspending the violating Customer from the Services and products; and/or
  • blocking the Customer's Services; and/or
  • terminating the use of Services by the violating Customer; and/or
  • charging fees to the violating Customer's account in accordance with the applicable service contract terms; and/or
  • removing offensive content; and/or
  • taking other actions in accordance with this AUP, the applicable service agreement or applicable law.

5.4 Preservation of Rights

The Company reserves the right to cooperate with appropriate legal authorities in investigating claims of illegal activity involving the Company's Services, Customers and other Users. The Company reserves all other rights to respond to violations of this AUP within the framework of applicable law and in accordance with any applicable contractual obligations. The Company may use technical means to monitor connections to its network facilities to prevent the introduction of viruses or other malicious software, prevent intrusions and otherwise ensure compliance with this AUP, and each Customer agrees that the Company is authorized to monitor its communications through the Company's network for such purposes.

6. Obligations

Users and Customers are obliged to familiarize themselves with this Acceptable Use Policy ("AUP"). Failure to familiarize does not exempt from responsibility and consequences of violation.
